293/2011 CONTRADICTORY ARGUMENT LIMITS THE JUSTICIABILITY OF HUMAN RIGHTS

Abstract

The resolution of the contradiction 293/2011 means an advance and a retreat, because although it established that human rights, without distinction of the source they come from, whether conventional or constitutional, constitute the control parameter of constitutional regularity, and that the jurisprudence of the Interamerican Court of Human Rights is binding for mexican judges, it established a restriction which delimits the interpretation of 1st constitutional article, limiting the justiciability of human rights.
