Abstract

This work is a brief analysis of the principle of justified mutability of the regime of benefits in the record of marriage, incorporated into the Brazilian legal system with the advent of the Civil Code of 2002. It is discussed for the concretization of the application of the principle: it is through judicial means ou administratively, through public deed.
