THE JURIDICAL PLURALISM AND THE RIGHTS TO HER PACHAMAMA

Abstract

From last decades of the century XX the juridical pluralism, you have collected relevance for his incidence at the social scene. From the Philosophy of the right and the Sociology, although with orientations and various views among themselves, they take care of in the definition new theoretic, requisite constructs to approach the essence of the juridical pluralism in the present-day context, reevaluándolo and offering him new springs of analysis. The Ecuadorian State guarantees the conservation and the development of his traditional forms of cohabitation and social organization to the indigenous towns, constitute an interculturalidad's expression. This has had a positive incidence in the constitutional protection to nature and his normative development as from the constitutional texts. The essay has like objective to demonstrate the constitutional recognition that they have devoted themselves to him the nature at the Ecuadorian nation, that has allowed being fastened of rights like juridical new thing under construction and evolution, as well as his normative development within the positive right and in the public policies.
