Abstract

This article demonstrates the importance of the function of the sentence enshrined in art. 18 of the Constitution, whose purpose is "the reintegration of the sentenced to society." Just as the strengthening of democratic criminal law, understanding criminal law as an instrument of peace, is based on the constant improvement in the quality of life in the economic, social and cultural sense of the people, built on principles that allow the consolidation democracy; of legality, offensiveness, humanity, reciprocity, guilt, non bis in idem, proportionality, minimal intervention, in dubio pro reo and ultima ratio.
