Abstract

The fundamental principles governing the application of criminal laws in space are the following: 1) territoriality; 2) flag (or protection of interests, or real or defense); 3) nationality or personality; and 4) universal law (or universality principle). International Criminal Law arises as the system of Criminal Law conceived to suppress the infractions that threaten the legal rights considered most relevant by the international community of States. National borders do not constitute a significant obstacle for the actions of criminal organizations.
