In this article, the author reflects on the legal aspects of the current Constitutional Treaty of the European Union. He analyses the efforts of a civil society developed through a draft European Constitution, which is becoming a fertile testing ground for all contemporary constitutionalism. This Constitution is essential not only because it introduces limits and links to the European decision-making bodies from which much of European law currently comes, but also because it contains rights and guarantees that are at risk of being undermined.
